In a ruling on July 23, 2020, the U.S. Court of Appeals for the Eighth Circuit reversed a lower court’s order that had enjoined Arkansas election officials from enforcing initiative-petition requirements that mandate in-person contact among canvassers, voters, and notaries public. In so holding, the Eighth Circuit contributed to an ongoing trend of the nation’s highest courts backing the decisions of state election officials during an election year complicated by the COVID-19 pandemic.
