Manhattan U.S. District Judge Dale Ho said it was necessary to dismiss the prosecution with prejudice, contrary to the government’s stated preference. Dismissal without prejudice, he said, “smacks of a bargain” hinging on the mayor facilitating the Trump administration’s immigration priorities.
